1. Acceptance of Terms
These Terms & Conditions (“Terms”) govern your access to and use of the website located at onremodeling.com (the “Site”), operated by ON Design & Remodeling (“Company,” “we,” “us,” or “our”), CA Contractor License #1080660 (CSLB), located at 1762 Technology Dr., Suite #226, San Jose, CA 95110. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Site.
2. Use of the Website
The Site is provided for informational purposes to help visitors learn about our construction, remodeling, and ADU services, view past projects, and request a consultation or estimate. You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use of, this Site by any third party.
3. No Binding Offer or Contract
Nothing on this Site constitutes a binding offer, bid, contract, or guarantee of pricing, availability, or project scope. All content, including project galleries, pricing references, and general timelines, is provided for illustrative and general informational purposes only. Any actual construction, remodeling, or ADU project will be governed exclusively by a separate, signed written home improvement contract between you and ON Design & Remodeling, prepared in accordance with California Business & Professions Code §7159 and other applicable law, which will include all legally required disclosures, including your right to cancel within three (3) business days where applicable.
4. Estimates and Quotes
Estimates or quotes requested through the Site are preliminary and non-binding until confirmed in a signed written contract following an in-person or virtual assessment of the project. Final pricing may vary based on site conditions, material availability, permitting requirements, and scope changes identified during the project.
5. Payment Terms
Payment terms, including deposit amounts, progress payment schedules, and final payment terms, will be set forth exclusively in your signed project contract and will comply with applicable California law, including limitations on down payments for home improvement contracts. No payment obligations are created through use of this Site alone.
6. Intellectual Property
All content on the Site — including text, graphics, logos, images, project photography, and website design — is the property of ON Design & Remodeling or its licensors and is protected by U.S. copyright and trademark law. You may not reproduce, distribute, modify, or create derivative works from any content on this Site without our prior written consent.
7. User Conduct
You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms
- Attempt to gain unauthorized access to the Site, servers, or connected systems
- Introduce viruses, malware, or other harmful code

- Impersonate any person or entity or misrepresent your affiliation with any person or entity

This disclaimer applies solely to the Site itself and does not limit, replace, or affect any warranty applicable to actual construction or remodeling work performed under a signed written contract, including any warranty obligations required by California law.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ON DESIGN & REMODELING AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY ARISING FROM YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).
This limitation applies only to claims arising from use of the Site and does not limit any liability arising under a separate signed construction or home improvement contract, which is governed by its own terms and applicable California law.
11. Indemnification
You agree to indemnify, defend, and hold harmless ON Design & Remodeling and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Site, or your violation of these Terms.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in Santa Clara County, California, and you consent to personal jurisdiction and venue in those courts.
13. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and ON Design & Remodeling regarding use of the Site and supersede any prior agreements or understandings, whether written or oral, regarding the Site.
15. Changes to These Terms
We may revise these Terms at any time by updating this page. The “Last Updated” date at the top reflects the most recent revision. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
